摘要:
检察机关是我国宪法确定的国家法律监督机关。检察机关对于行政违法行为的监督 具有保障法律正确实施、惩戒权力滥用的功能。因此,应重构行政检察监督体系,合理界定权力边 界,以制度保障检察监督对具体行政行为和抽象行政行为的监督效力。
Abstract:
Theprocuratorialauthorityisthestateorganizationoflegalsupervisiondeterminedbythe constitutionofourcountry.Thesupervisionoftheadministrativeillegalactsbytheprocuratorialorgans hasthefunctionofensuringthecorrectimplementationofthelawandtheabuseofthepunishmentpower. Therefore,weshouldreconstructthesystemofadministrativeprocuratorialsupervision,definetheboundaryofpowerreasonably, andguaranteetheeffectivenessofprocuratorialsupervisiononspecificadministrativeactandabstractadministrativeactwiththesystemtoma imizethepositiveroleofprocuratorialsupervisionintheconstructionoftheruleoflaw.
